SpellCrush is an educational web application designed to help children practice spelling through gamified exercises. The Service includes:

• Spelling practice sessions with audio pronunciation

• Virtual rewards system
• Premium features including custom word lists and AI-powered hints

3. User Accounts

3.1 Parent/Guardian Accounts

You must be at least 18 years old to create a parent account. You are responsible for:

• Maintaining the security of your account credentials
• All activities that occur under your account
• Ensuring the accuracy of information provided
• Supervising your children's use of the Service as appropriate

3.2 Child Profiles

Child profiles are created by parents/guardians. We comply with COPPA (Children's Online Privacy Protection Act) and do not collect personal information directly from children under 13. See our Privacy Policy for details.

4. Subscription and Billing

4.1 Free Tier

The free tier includes access to one (1) child profile and standard spelling word lists.

4.2 Premium Subscription

Premium subscription is billed monthly at $4.99/month and includes:

• Unlimited child profiles
• Custom word list creation
• AI-powered spelling hints
• Advanced analytics

4.3 Payment Terms

• Subscriptions automatically renew each month unless canceled
• You will be charged on the same day each month based on your initial subscription date
• All fees are in U.S. dollars and are non-refundable
• We reserve the right to change pricing with 30 days' notice to existing subscribers

4.4 Cancellation

You may cancel your subscription at any time from your account dashboard or billing portal. Cancellation takes effect at the end of your current billing period. You will retain access to Premium features until the end of the paid period.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Share your account credentials or family login link with unauthorized users
• Attempt to interfere with, compromise, or disrupt the Service
• Use automated tools to access the Service without authorization
• Upload inappropriate, offensive, or harmful content to custom word lists
• Reverse engineer or attempt to extract source code

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by SpellCrush and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

Custom word lists created by users remain the property of the user, but you grant us a license to store and display them as necessary to provide the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

SpellCrush is an educational tool and supplement. We make no guarantees regarding educational outcomes or improvements in spelling ability.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPELLCRUSH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
